By accessing or using our Website, purchasing our courses, or participating in our community hub, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, please do not use our Services.
1. NO FINANCIAL ADVICE
1.1 Educational Purposes Only: All content provided by Smart Online Trader, including but not limited to the 13-Module Curriculum, Trade Ideas & Analysis, live coaching, and community discussions, is for educational and informational purposes only.
1.2 No Advice: We do not provide financial, investment, tax, or legal advice. Smart Online Trader LLC is an Introducing Broker and is not a Financial Services Provider (FSP) as defined under the South African Financial Advisory and Intermediary Services Act, 2002 (“FAIS Act”).
1.3 Self-Managed Trading: Any trading decisions you make are your own. We do not manage money or trade on behalf of clients.
2. RISK DISCLOSURE
2.1 High Risk: Trading Foreign Exchange (Forex), CFDs, Commodities, and Cryptocurrencies involves a high level of risk and may not be suitable for all investors. You may lose more than your initial investment.
2.2 No Guarantees: Past performance is not indicative of future results. We do not guarantee profits or the prevention of loss.
2.3 Capital at Risk: You should only trade with money you can afford to lose.
3. SERVICES AND SUBSCRIPTIONS
3.1 Course Access: Upon purchase, you are granted a non-exclusive, non-transferable license to access the Smart Online Trader Learning Management System (LMS).
3.2 Evaluation and Simulated Funding: Our “Simulated Funded Account” programs (e.g., Nebula) utilize demo/simulated environments. Passing an evaluation does not entitle you to a “real money” brokerage account but rather a performance-based reward system within a simulated environment as governed by our specific program rules.
3.3 Third-Party Platforms: We utilize Match-Trader and TradingView technology. Your use of these platforms is also subject to their respective terms and conditions.
4. INTRODUCING BROKER ROLE
4.1 QuickTrade Relationship: Smart Online Trader LLC acts as an Introducing Broker to QuickTrade World (Pty) Ltd.
4.2 Counterparty: QuickTrade World (Pty) Ltd acts as the principal and counterparty to all client trades. We are not responsible for the execution, clearing, or settlement of trades performed on their platform.
5. USER CONDUCT AND COMMUNITY RULES
5.1 Account Security: You are responsible for maintaining the confidentiality of your login credentials.
5.2 Prohibited Use: You may not use our Services for any illegal purpose, nor may you “scrape,” redistribute, or resell our educational content without express written permission.
5.3 Community Hub: When using the Hub or Telegram channels, you must remain respectful. We reserve the right to remove users who engage in harassment, spamming, or the solicitation of other members.
6. PAYMENTS AND REFUNDS
6.1 Fees: All fees for courses and evaluations are stated on the Website.
6.2 Refund Policy: Due to the digital nature of our educational content, refunds are generally not provided once the course material has been accessed. For evaluation fees, refunds are only issued if specifically stated in the program rules (e.g., “Performance-based fee refund” upon passing).
7. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Smart Online Trader LLC, its directors, employees, and affiliates shall not be liable for any direct, indirect, incidental, or consequential loss or damages resulting from:

Trading losses incurred by you.
