Community Hub Terms

1. INTRODUCTION AND SCOPE

These Terms and Conditions (“Community Terms”) govern your access to and use of the Smart Online Trader Client Portal and Community Hub, accessible at hub.smartonlinetrader.com (“The Hub” or “The Community”), operated by Smart Online Trader S.A., a brand of Diversit-e Smart Trade College (Pty) Ltd (Registration No. 2026/199265/07).

The Hub is a private digital platform available exclusively to active SOT programme Members and registered Performance Lab participants. Access to The Hub is a benefit of your SOT membership or programme enrolment and is subject to these Community Terms at all times.

By accessing The Hub, you confirm that you have read, understood, and agree to be bound by these Community Terms. These Community Terms are supplementary to and incorporated into your Terms and Conditions of Purchase and do not replace them. In the event of any conflict, the Terms and Conditions of Purchase shall prevail.

2. ACCESS AND ELIGIBILITY

2.1 Who May Access The Hub

Access to The Hub is restricted to Clients who hold an active, paid-up membership or programme enrolment with SOT. Access will be activated following successful payment of the Agreement Amount or the first agreed instalment and completion of all onboarding steps.

2.2 Login Credentials

Each Member is issued unique, personal login credentials (username and password). You are solely responsible for:

  • maintaining the confidentiality and security of your login credentials;
  • all activity conducted through your account, whether authorised by you or not;
  • immediately notifying SOT of any suspected unauthorised use of your account or any other security breach at helpme@smartonlinetrader.com.

Your credentials are strictly personal and non-transferable. Sharing your credentials with, or granting access to, any third party who is not an enrolled SOT Client is strictly prohibited and will result in immediate suspension of your access without refund.

2.3 Access Duration

Your access to The Hub is tied to the duration of your active membership or programme subscription. Access will automatically terminate upon:

  • the natural expiry of your agreed membership or programme term;
  • valid cancellation within the statutory Cooling-Off Period (see Terms and Conditions of Purchase);
  • default on payment obligations under your Purchase Agreement, subject to a reasonable notice period where required by the CPA;
  • suspension or permanent removal for breach of these Community Terms.

SOT will endeavour to provide reasonable advance notice of access termination where it is not caused by the Client’s breach.

3. CONTENT AVAILABLE IN THE HUB

The Hub provides Members with access to the following content and features, subject to the specific tier enrolled:

  • Course Modules: Structured online trading education content accessible via the LMS (content varies by membership tier).
  • Live Mentoring Sessions: Expert-led live coaching sessions scheduled and delivered by SOT instructors.
  • Daily Market Analysis Videos: Regular video content covering market conditions, chart setups, and trading perspectives.
  • Trade Ideas and Analysis: Educational trading insights, signals, and chart analyses shared by SOT’s course specialists via The Hub and/or a linked Telegram channel.
  • Community Boards: Peer-to-peer discussion boards for Member engagement and collaboration.
  • Resources Library: Downloadable educational guides, templates, reference materials, and recorded sessions.
  • Performance Lab Dashboard: Evaluation status tracking and Simulated Funding account management interface (for Performance Lab Members).

SOT does not guarantee the accuracy, completeness, or timeliness of any trade idea. You trade entirely at your own risk and are solely responsible for all trading decisions.

4. COMMUNITY CONDUCT AND GUIDELINES

4.1 Expected Conduct

The Hub is a professional, supportive educational community. All Members must engage respectfully, constructively, and in good faith at all times. By participating in The Hub, you agree to:

  • treat all Members, SOT staff, coaches, and instructors with dignity and respect;
  • contribute honestly and constructively to community discussions;
  • respect the intellectual property of SOT and of other Members;
  • comply with all applicable South African law at all times.

4.2 Prohibited Conduct

The following conduct is strictly prohibited and may result in immediate suspension or permanent removal from The Hub without refund, subject to the Client’s statutory rights under the CPA:

  • posting, sharing, or distributing spam, unsolicited advertising, or promotional content for any third-party product or service;
  • reproducing, sharing, or distributing SOT course material, trade ideas, or resources outside The Hub without SOT’s prior written consent;
  • engaging in harassment, bullying, intimidation, defamation, threatening behaviour, or hate speech directed at any person;
  • posting offensive, obscene, discriminatory, pornographic, or otherwise unlawful content;
  • impersonating any SOT staff member, instructor, or other Member;
  • sharing login credentials with or granting Hub access to any non-enrolled person;
  • soliciting or promoting investment schemes, pyramid schemes, unlicensed financial services, or any other scheme that could constitute a contravention of applicable South African law;
  • making posts that could be construed as financial advice (non-SOT-staff Members only);
  • attempting to reverse-engineer, copy, extract, or circumvent any part of The Hub’s technology, security measures, or content;
  • any conduct that disrupts The Hub, harms SOT, or is detrimental to the interests of other Members;
  • continuing any prohibited conduct during or after a formal complaints or dispute process.

4.3 Moderation

SOT reserves the right, but assumes no obligation, to monitor activity within The Hub, remove any content that violates these Community Terms, and suspend or permanently revoke a Member’s access, in each case at SOT’s sole and reasonable discretion. SOT will act fairly but is not required to give prior warning before taking action in response to serious or clear violations.

5. INTELLECTUAL PROPERTY

All content within The Hub, including course modules, videos, trade ideas, analyses, templates, guides, recorded sessions, and community features, is the intellectual property of SOT and/or its licensed suppliers, protected under the Copyright Act, 98 of 1978.

Members are granted a limited, non-exclusive, non-transferable, revocable licence to access and use Hub content solely for their own personal, non-commercial educational purposes during the active membership period. Members may NOT:

  • reproduce, copy, screenshot, record, or redistribute any Hub content;
  • share Hub content with non-Members via any medium or channel;
  • use Hub content for any commercial purpose;
  • create derivative works based on Hub content without SOT’s express prior written consent.

6. TELEGRAM TRADING CHANNEL

Trade ideas and analysis may be delivered to Members via one or more linked Telegram channels in addition to The Hub. The Client is responsible for:

  • accepting the Telegram channel invitation using the link provided by SOT Technical Support;
  • compliance with Telegram’s own terms of service and community guidelines;
  • understanding that Telegram is a third-party platform and SOT is not responsible for Telegram’s availability, functionality, or privacy practices.

Trade ideas shared via Telegram are published by SOT’s course specialists based on personal trading strategies and market analysis. They are published as and when opportunities are identified and are provided for educational purposes only. They are not financial advice, and there is no guaranteed frequency of publication.

7. TECHNICAL REQUIREMENTS AND SERVICE AVAILABILITY

Access to The Hub requires a stable internet connection (ADSL, fibre, or LTE). Data and connectivity costs are entirely for the Member’s account. SOT endeavours to maintain The Hub as a reliable and accessible platform but does not guarantee uninterrupted, error-free service. The Hub may be unavailable due to:

  • scheduled maintenance (SOT will endeavour to provide reasonable advance notice);
  • emergency maintenance or technical failures;
  • force majeure events beyond SOT’s reasonable control;
  • third-party platform failures, including hosting providers or Telegram;
  • the Member’s own connectivity or device issues.

SOT shall not be liable for any losses incurred as a result of any unavailability or interruption to The Hub.

8. SUSPENSION AND TERMINATION OF ACCESS

SOT reserves the right to suspend or permanently terminate a Member’s access to The Hub in the event of:

  • a material breach of these Community Terms;
  • default on any payment obligation under the Purchase Agreement, subject to a reasonable cure period;
  • the natural expiry of the membership or programme term;
  • any conduct that is harmful, illegal, or seriously prejudicial to SOT or its Members.

Where suspension is applied for reasons other than the Client’s own breach (e.g., administrative matters), SOT will endeavour to restore access promptly upon resolution. Where access is permanently terminated for breach, any accrued but unpaid amounts under the Purchase Agreement remain due and payable in full. Termination of access does not entitle the Client to a refund after the Cooling-Off Period.

9. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable South African law, SOT shall not be liable for any direct, indirect, or consequential loss, damage, or expense arising from your use of or reliance on The Hub, its content, trade ideas, or community interactions, including any trading losses. This limitation does not exclude any liability that cannot lawfully be excluded.

10. GOVERNING LAW AND AMENDMENTS

These Community Terms are governed by the laws of the Republic of South Africa, including ECTA, 25 of 2002, POPIA, 4 of 2013, and the CPA, 68 of 2008. The Client’s statutory rights under all applicable legislation are preserved in full.

SOT reserves the right to amend these Community Terms at any time. Updated terms will be published on The Hub and the Website. For material amendments, at least 14 days’ written notice will be provided to active Members. Continued use of The Hub after the effective date of amendments constitutes acceptance.
